Lawsuits Piling Up Against Seneca Casino Gambling In Buffalo
Listening to the Citizens Against Casino Gambling tell the story, they have already been successful with two prior lawsuits to shut down the Seneca Nation of Indians casino in Buffalo, New York. Much to the group's dismay, the gambling has continued at the casino.
The reason for that is that the Chairman of the National Indian Gaming Commission, Phillip N. Hogen, approved the Seneca gambling ordinance on the day Obama was sworn into the White House. That has allowed the tribe to keep the casino operating.
U.S. District Judge William M. Skretny is being asked again to change his decision that has called a nine acre piece of land sovereign for the Seneca's. The Seneca's have had no comment on the latest lawsuit.
"We have won two lawsuits," said Diane Bennett, a lawyer and president of Citizens for a Better Buffalo, "This is the lawsuit we feel will end the abuse of the law."
The problem as these gambling opposition groups see it, it that the Gaming Commission ruling ignored the intent of Congress when they made the law. The Congress never intended for the Indian tribes to be able to place land into sovereignty for gambling purposes.
The Senecas have constructed a temporary facility where they have been conducting their casino business. They halted construction of the permanent facility late last year when the economy took a turn for the worst.
