Supreme Court Says Georgetown County Cannot Outlaw Gambling Boats
The state Supreme Court has ruled that Georgetown County did not have the authority to pass an ordinance banning casino boats from the area.
In an opinion handed down Monday, the court wrote precedent makes clear that the state can outlaw the gambling day cruises, not a county. During February arguments, Chief Justice Jean Toal told an attorney for the county, "you're criminalizing conduct which is legal statewide."
In Monday's opinion, justices cited an article of the state constitution supporting Toal's statement. A new state law gives local governments the right to ban or regulate casino boats, but Georgetown County passed its ordinance before the state law was approved.
