City Council Call for Bergson Gambling Probe stays alive Monday

Duluth City Council voted Monday to table a resolution seeking an independent investigation of Mayor Herb Bergson.The resolution would have the city hire an independent attorney with prosecuting authority to investigate whether Bergson broke the law when he shared a draft report by Minnesota's Legislative Auditor Jim Nobles with the Duluth News Tribune in May 2005.

Under state law, the draft report wasn't public data and Bergson had an obligation to protect its contents, according to a letter from Nobles, who also called for an investigation into whether Bergson committed a misdemeanor by handing the report over to the newspaper. The draft and subsequent official report detailed problems with contracts the city held with the Duluth-based Minnesota Council on Compulsive Gambling. Among other things, the report showed the council received payment for costs not allowed under its contract with the city or the state.
