Fantasy Sports To Stand Trial

The fantasy sports industry will soon be be meeting it's day in court, as lawyer Charles Humphrey, who has a law firm dedicated to gambling law, is trying to envoke a law from 1710. The law was enacted to keep aristocrats from gambling away their inheritance.

In the law suit Humphrey claims that fantasy sports, when run by companies, is illegal. Humphrey stated, "Most people don't understand that even if some skill is involved....it doesn't mean it's a game of skill."

The lawsuit zeroes in on only the people who pay money to enter a league through a third party such as CBSSportsline, or ESPN.

Although trying to capitalize on a law that has not been enforced in one hundred years, if Humphreys wins, he hopes to collect the entry fees paid to the companies by fantasy league players, except money paid out in prizes.

The basis for this lawsuit is state laws from England. The law allows a private citizen to sue for losses from illegal gambling.

None of the companies named in the lawsuit including CBSSportsline.com, ESPN, or The Sporting News commented on the pending litigation.
