Gambling Addict Brings Case Against Casino To Indiana Supreme Court

There have been many lawsuits that have popped up across the world regarding gamblers who have addictions that have been solicited by casinos. The latest of these cases is being heard by the Supreme Court in Indiana.

Attorney Terry Noffsinger, representing Jenny Kephart, laid out his clients case during a hearing in front of the Supreme Court on Thursday. The lawyers spoke of how the former Caesars Indiana preyed on Kephart, an admitted gambling addict, because she had a lot of money.

Noffsinger has presented the argument that the casino should be aware that customers exclude themselves from casinos and that the casino should be responsible for going after these gamblers with addiction problems. The attorney also argued that the casinos should not be exempt from liability.

It is a common argument for people with gambling addictions who have gone after casinos for their gambling losses. In most cases, the law has remained on the side of the casinos, claiming that the individuals are ultimately responsible for their own actions.

The casino also had an attorney present on Thursday to argue their side of the case in front of the Supreme Court. Attorney gene Price is representing the casino, which is no longer known as Caesars Indiana. The casino has been re-branded as Horseshoe Southern Indiana.

Price played to the fact that the casinos in Indiana are heavily regulated and are constantly under pressure to keep gambling addicts out of the casino. The court will take some time to analyze the arguments from Thursday, and will most likely not rule on the case until next year.
