The Task Force on Illegal Gambling has been the center of debate in Alabama for the better part of the past year, and it now appears the Supreme Court will have the final say on its future. This comes after a circuit court judge questioned the authority of Task Force head John Tyson.
Tyson took over as the head of the Task Force and in the time since, there have been questions surrounding whether he has authority to order raids outside of his home county of Mobile.
Macon County officials filed a lawsuit claiming that Tyson had no jurisdiction in their county. A circuit court judge cited that lawsuit on March 5th, and issued an order preventing gambling raids within the county.
VictoryLand, one of the biggest gambling establishments in the state, had shut down prior to the order for fear of being raided. Once the order was issued, VictoryLand re-opened, sending many Alabamians back to work. VictoryLand is one of the largest employers in Alabama.
Macon County officials are now asking the Supreme Court to throw out the appeal of the restraining order that was issued allowing VictoryLand to re-open.
"We're also saying that just because the governor disagrees with the local officials and their enforcement of the law, he cannot employ his own special prosecutor," said Montgomery Attorney John Bolton, "The governor has the authority to intervene in cases to represent his own interests."
