Colorado Smoking Ban Does Not Affect Tribal Casinos

The Colorado attorney general filed more arguments June 22 defending a new statewide smoking ban, saying opponents were "highly unlikely" to prove the law would violate their constitutional rights. With a court date looming, Attorney General John Suthers said in documents filed in federal court that opponents failed to show they would suffer irreparable harm under the law, and their motion seeking to block the ban from taking effect July 1 should be dismissed.

In fact, postponing the law would delay millions of Coloradans from being protected from secondhand smoke, Suthers argued. A hearing was scheduled June 23 on a request from a coalition of 500 bar owners, bowling alleys, liquor stores and others to temporarily block the law while a lawsuit proceeds. Attorney Joseph Becker, representing the coalition, had not yet seen Suthers' new arguments and had no immediate comment on them.
