iMEGA Will Get Day In Court Versus Online Gambling Law In July

It now may be a matter of what comes first for the Interactive Media Entertainment and Gaming Association (iMEGA) when it comes to the Unlawful Internet Gambling Enforcement Act. Will their legal case challenging the constitutionality of the UIGEA come before Representative Barney Frank and his fellow lawmakers overturn the ill-advised law?

On Thursday, a court date was set for lawyers from iMEGA to argue their case against the UIGEA. Monday, July 6th is the day the Third Circuit Court of Appeals will hear iMEGA's arguments.

"The court is going to look the entire case without technicalities and filing dates," iMEGA chairman Joe Brennan told Poker News Daily, "They are going to solely decide it on the merits, not based on anything political or regarding procedure. That's why you have a judicial system."

In recent months, New Hampshire has reported problems relating to the UIGEA when it comes to their legal online lottery sales. They claim that credit card companies are blocking their customers from purchasing lottery packages online.

North Dakota has reported similar difficulties, even though the sale of the lottery tickets are not illegal under the UIGEA. Whether to admit this information into the iMEGA case has been a sticking point between iMEGA lawyers and the Federal Government.

While iMEGA waits on the July court date, Representative Barney Frank is expected to introduce legislation that would overturn the UIGEA and pave the way for regulation and legalization of Internet gambling. That legislation is expected before the end of the month.
