Kentucky Man Sues Indiana Casino For Loaning Him Funds While Drunk
A gambler lost $75,000 at the former Caesars Casino in Indiana back in 2004, and now he is fighting to have the debt wiped out. Jimmy L. Vance, from Indiana, has sued the casino, claiming they took advantage of his drunk state.
Vance admitted to gambling at the casino, which now is called the Horseshoe Southern Indiana. His lawyer is contending, however, that he only remembers borrowing the first $20,000 from the casino, and that after that he was drunk.
"He had at least seven drinks in 160 minutes," said Attorney Larry Wilder, "He remembers borrowing the first $20,000, but not the last $55,000." that will be the defense that Wilder hopes will get Vance out of his debt.
The casino, meanwhile, has a big incentive to hope that Vance has to repay the marker. Under Indiana law, the casino can charge interest and collect three times the original debt. Lawyers fees and court costs could be added on as well.
The casino does have to worry about their end of the deal. If they knew that Vance was inebriated, then Indiana law could dictate that a legal agreement to pay back the loan could be at stake.
Many gamblers have attempted to blame their gambling losses on casinos in the past. Several have sued the casino, claiming that the casino took advantage of their gambling addictions. The casinos, however, have come out on top in the court of law, with judges holding the gamblers responsible for their own actions.
