Prop 8 Stay Leads To Same-Sex Partners Gambling On Marriage

In what will go down as one of the landmark cases for same-sex marriage, Judge Vaughn Walker, who overturned the ban on same-sex marriage in California, has now issued a prop 8 stay, meaning the marriages are again able to take place in the state.

The judge had been under pressure from Governor Arnold Schwarzenegger and others to permanently lift the ban so that same-sex partners can begin getting married in California. On Thursday, that decision was made and it resonated throughout the country.

"I think it is great that people who love each other will no longer be discriminated against in California," said Bill Stern. "many of these couples have more stable relationships than heterosexual couples, and they deserved the right to get married."

Proposition 8 was challenged by two couples who felt they were not equally protected as heterosexual couples under the amendment to the constitution. Judge Walker agreed, and overturned the amendment, but he also issued a suspension of the same-sex marriages until all of the appeals were heard in the case.

Appeals were filed but the increasing pressure from the governor and others pushed Walker to today's decision. The judge did, however, leave another week of the suspension to give all the parties involved time to appeal. Those who thought they would be allowed to marry will now have to wait one more week.

Schwarzenegger, a Conservative that has shown the ability to rise above partisan politics, commended the judge on his actions on Thursday.

"I am pleased to see Judge Walker lift his stay and provide all Californians the liberties I believe everyone deserves," said Schwarzenegger after Judge Walker's written ruling was handed down.
