The Internet Gambling Ban Finally Analyzed by an Expert

Allyn Jaffrey Shulmah, a lawyer with some real credentials in studying and interpreting legal statutes, has finally put some expert and honest analysis into the Unlawful Internet Gambling Enforcement Act of 2006.

Her analysis was revealed on CardPlayer.com. She is the wife of the owner of the popular poker site and she has worked as a lawyer who taught other lawyers how to interpret statutes. She also worked as a lawyer analyzing legal issues for 25 years and for 15 of those years she also worked as a legal expert answering legal questions on a legal hotline.

After reading Mrs. Shulmah's article you will wonder if perhaps Party Poker and 888 should have sought her legal advice before destroying their respective companies.

Mrs. Shulmah revealed in her article that the new US bill does absolutely nothing to change the legal landscape of internet gambling. It especially does not make online poker illegal, as it was never illegal before the law. In her own words, "the bill merely speaks to the mechanism by which an online account is funded." Nothing more, nothing less.

She explains that the new law simply makes it possible to enforce laws that already existed. Which leads us to the question, what laws do already exist? The answer... online sports betting is illegal. Online poker is not.

In a court case in 2001 where 33 cases were consolidated into one Judge Stanwood R. Duvall Jr. ruled that the Wire Act only prohibited wagering on sporting events and he dismissed all 33 cases. The District Court of Appeals agreed with the ruling. She points out that District courts can, and normally do, disagree with each other, but Duvall's judgement was so solid that no one would dare challenge his ruling.
